Court of Criminal Appeal overturned our client’s murder conviction

Case: Our client was charged with murder, alleged to have drowned his fiancé in a bath tub in their home. In 1995, our client was convicted by jury. Our client spent 20 years in gaol and exhausted his appeal right. In 2013, following enactment of the secondary appeal regime, our client engaged Barbaro Thilthorpe Lawyers to act on a secondary appeal to the Full Court of the Supreme Court of South Australia.

Outcome: Our client’s appeal was successful, with the court finding that there was a miscarriage of justice in our client’s case due to incorrect forensic evidence led by prosecution. Our client’s conviction was overturned. The Director of Public Prosecutions later entered a nolle prosequi, abandoning the prosecution of our client.
